Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of King of the Touge ("KOTT", "the Service", "we", "us", or "our"), a competitive online racing service for the PC racing simulation Assetto Corsa.
By accessing the Service — including by visiting kingofthetouge.com, joining a KOTT-operated Assetto Corsa server, linking your Steam or Discord account, or otherwise interacting with the Service — you agree to be bound by these Terms. If you do not agree, you may not use the Service.
These Terms incorporate by reference our Privacy Policy.
2. Service Description
KOTT is a community-operated competitive racing service offering three game modes:
- Matchmaking — ranked best-of-three series with skill-based
pairing using the Glicko-2 rating system.
- Time Attack — solo timed-lap leaderboards with server-authoritative
validation.
- Free Roam — queueless hangout with on-demand 1v1 challenges.
The Service is provided free of charge during public testing. We reserve the right to introduce paid tiers, features, or services in the future, with notice given before any charge applies to existing users.
3. Eligibility
You must meet the following requirements to use the Service:
- You are at least 13 years old, or the age of digital consent in
your country of residence (16 in most EU jurisdictions for ranked features that require account creation).
- You are at least 16 years old to participate in ranked Matchmaking.
- You own a legitimate licensed copy of Assetto Corsa and comply with
its end-user license agreement.
- You are not barred from using the Service under the laws of your
jurisdiction or any prior enforcement action by us.
- You are not currently subject to a permanent ban from the Service.
By using the Service you represent that all of the above are true.
4. Accounts and Authentication
4.1. Steam OAuth (required)
Authentication to the Service uses Steam OpenID. Your Steam account is your canonical identity on KOTT. We do not collect your Steam password, email, or private profile data — Steam returns only your Steam ID (64-bit integer), public display name, and avatar URL.
You are responsible for keeping your Steam credentials secure and for all activity that occurs under your Steam ID on the Service.
4.2. Discord OAuth (optional)
You may optionally link a Discord account to receive match notifications, queue updates, and rank role assignments. Linking is voluntary and can be reversed at any time using the `/unlink` command in the KOTT Discord.
4.3. One account per person
You may not create or use multiple accounts for the purpose of manipulating ranked play (commonly known as "smurfing"). Multiple accounts owned by the same person, including alt accounts, may be banned at our discretion if used to circumvent rating, bans, or matchmaking restrictions.
5. Acceptable Use
You agree NOT to:
- Cheat. Use any tool, modification, exploit, or technique that
provides an unfair advantage in races. This includes physics modifications, speed hacks, ESP/wallhacks, server-disallowed driving assists, telemetry-injection tools, and lap-validation bypasses.
- Manipulate ratings. Win-trade, account-share, deliberately lose
matches, abuse smurfing, or otherwise distort the skill-rating system.
- Grief. Intentionally ram, block, or impede other racers; abuse
match-cancellation; abandon ranked matches in bad faith.
- Harass. Send slurs, threats, hate speech, sexually explicit
material, or other abusive content via in-game chat, Discord, profile display name, or any other Service surface.
- Impersonate. Pretend to be a member of KOTT staff, a moderator,
or another player.
- Disrupt the Service. Attempt to overload, scrape aggressively,
reverse-engineer for malicious purposes, exploit security flaws without disclosure, deny service to other users, or interfere with Service infrastructure.
- Misuse data. Scrape, redistribute, or republish player data
obtained from the Service except for your own personal Steam ID data.
6. Telemetry and Race Data
Recording how you drive is not incidental to this Service — it is the Service. By using it you acknowledge and agree that:
- The Service captures server-authoritative telemetry for every lap
— sector splits, top speed, off-track and collision counts, finish times, position traces. This data is required for lap validation, anti-cheat, and dispute resolution.
- The Service may capture client-side rich telemetry — 20 Hz samples
across 55 channels including your control inputs, g-forces and per-wheel tyre state — for the duration of a lap. This is gated on a feature flag and on your acceptance of these Terms. It is visible only to you, on your own lap pages.
- Chat messages you send on a KOTT server are recorded with your Steam ID
and retained for moderation. Do not type anything into chat you would not want recorded.
- While you are connected, your on-track position is broadcast publicly in
real time on the live server map, along with your display name, crew tag, rank and best time.
- Race results, rating changes, and lap times are visible publicly on
the leaderboards, your player profile, and the Service's match history pages.
- Aggregated, anonymized statistical data may be retained indefinitely
for service-quality and historical-record purposes even after you delete your account.
We process this data under the contract these Terms create and, for anti-cheat and moderation, under our legitimate interests — not under separate consent. That means there is no consent for you to withdraw, and no in-Service switch to turn data collection off. What you can do instead: stop using the Service, and exercise your right to erasure (Privacy Policy §7.3), which removes your data from the live Service. Your right to object under Article 21 is unaffected.
Detailed traces are not kept forever — see the retention table in the Privacy Policy §6. Results and lap times are; the granular recordings behind them are deleted on a schedule.
7. Bans, Suspensions, and Appeals
7.1. Enforcement
We may issue warnings, mutes, temporary suspensions, or permanent bans against accounts that violate these Terms, at our sole discretion. Ratings or laps obtained through cheating or manipulation may be reset, removed, or invalidated.
Bans may be scoped (Service-wide or limited to specific tenants / operator-run servers).
7.2. Appeals
Ban appeals are processed via the KOTT Discord support channel. Open a ticket or DM a moderator with your Steam ID and a description of the circumstances. Repeat or abusive appeal submissions may be rate-limited.
We do not commit to a specific appeal turnaround time during public testing.
8. Service Availability
The Service is provided on a best-effort basis during public testing. We make no commitments regarding:
- Uptime, response time, matchmaking latency, or pairing speed.
- Preservation of any specific match record, lap time, rating, or
season result.
- Continuous availability of any specific game mode, server, or
feature.
We may schedule maintenance windows, take the Service offline for upgrades, or temporarily disable specific features. Where practical we publish maintenance windows on the /status page and announce significant downtime in the KOTT Discord.
9. Account Termination
9.1. By you
You may delete your account at any time from your profile page using the self-serve "Delete my account" action. Deletion schedules a 30-day grace window after which your data is permanently erased per our Privacy Policy. You may cancel the scheduled erasure during the grace window.
9.2. By us
We may suspend or terminate your account if:
- You materially violate these Terms.
- You engage in conduct that harms other players or the Service.
- We cease operating the Service (in which case we will give
reasonable notice).
- Required by law, court order, or legal process.
Termination by us does not entitle you to compensation, refund (no fees apply during public testing), or restoration of your data.
10. Operator-Run Servers (Tenants)
The Service supports third-party operators ("Operators") who run their own AssettoServer instances against the central KOTT Service.
When you race on an Operator's server:
- Your race data, ratings, and lap times still flow through the central
KOTT Service and remain governed by these Terms.
- The Operator can apply tenant-scoped moderation actions (bans, mutes)
affecting access to their servers only. KOTT staff may apply Service-wide actions.
- The Operator's branding, server rules, and conduct policies may
apply in addition to these Terms while you are on their servers.
We do not warrant the conduct, uptime, or moderation practices of third-party Operators.
11. Intellectual Property
11.1. Service content
KOTT, the KOTT logo, the King of the Touge name, the Service's user interface, source code, design tokens, and aggregated leaderboard data are owned by KOTT and protected by intellectual property law.
You may NOT use KOTT branding to suggest endorsement of unaffiliated products, services, or communities. Embedding leaderboard widgets or linking to player profiles for ordinary community use is permitted.
11.2. User submissions
You retain ownership of any content you submit to the Service (profile display name, dispute messages, feedback, telemetry). By submitting content you grant us a non-exclusive, worldwide, royalty-free license to display, archive, aggregate, and process that content within the Service for community features (leaderboards, records, anti-cheat, dispute resolution, archival match records) and for the duration these features remain in use.
11.3. Third-party intellectual property
The Service depends on Assetto Corsa (Kunos Simulazioni), Custom Shaders Patch, AssettoServer, Steam (Valve), and Discord (Discord Inc.). KOTT is not affiliated with, endorsed by, or sponsored by any of these. All trademarks are the property of their respective owners.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Defects will be corrected.
- The Service or the servers that make it available are free of
viruses or other harmful components.
- Any specific result, ranking, match outcome, or lap time will be
preserved.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KOTT, ITS OPERATORS, AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE OR YOUR INABILITY TO ACCESS OR USE THE SERVICE.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.
Your sole and exclusive remedy for dissatisfaction with the Service is to stop using it.
Nothing in these Terms is intended to exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
14. Indemnification
You agree to indemnify and hold harmless KOTT, its operators, and its contributors from any claim, demand, loss, or damages (including reasonable legal fees) arising out of:
- Your breach of these Terms.
- Your violation of any law or third-party right.
- Your conduct on or use of the Service.
15. Modifications to These Terms
We may update these Terms from time to time. When we do:
- The "Last updated" date at the top of `/terms` will be revised.
- Material changes will be announced via the Service (banner on the
home page and `/terms` page) and in the KOTT Discord at least 14 days before they take effect, where practicable.
- Continued use of the Service after the revised Terms take effect
constitutes your acceptance of them.
If you do not agree to the revised Terms, your remedy is to stop using the Service and (optionally) delete your account.
16. Governing Law and Disputes
16.1. Governing law
These Terms are governed by the law of the operator's country of residence. The Service is operated by an individual rather than a company, and we have not nominated a specific governing law beyond that; where no choice of law is effective, the applicable law is determined by ordinary conflict-of-law rules.
16.2. Disputes
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service should be raised with us first at `nack@kingofthetouge.com` — we would much rather resolve it directly. Where a dispute cannot be resolved that way, it falls to the courts having jurisdiction under ordinary rules, except where mandatory consumer-protection law in your country of residence provides otherwise.
If you are an EU/UK consumer, this clause does not deprive you of the protection of mandatory provisions of the law of your country of residence.
17. Severability and Entire Agreement
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of these Terms remains in full force.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and KOTT regarding the Service and supersede any prior agreements.
